Welcome to InstaCOM – Social Media Commentor (the “Extension”). These Terms and Conditions (“Terms”) govern your access and use of our website https://instacom.cloud and the InstaCOM Chrome Extension. By using our services, you agree to comply with these Terms. If you do not agree, you must not use our services.

1. Eligibility

  • You must be at least 13 years old to use InstaCOM.

  • By using InstaCOM, you represent that you meet this age requirement and that you are legally capable of entering into this agreement.

2. License and Use

  • We grant you a limited, non-exclusive, non-transferable, revocable license to install and use InstaCOM solely for personal or business use.

  • You must not:

    • Copy, modify, or reverse-engineer the Extension.

    • Use InstaCOM for unlawful, abusive, or harmful purposes.

    • Circumvent restrictions or misuse the AI-generated outputs.

3. Accounts and Security

  • You agree to provide accurate and complete information during registration (name, email, etc.).

  • You are responsible for maintaining the confidentiality of your account and activities.

  • We are not liable for losses due to unauthorized access caused by your negligence.

4. Payments and Subscriptions

  • Payments are processed via trusted gateways including Razorpay, Cashfree, Stripe, PayU, PhonePe, Paytm, PayPal, and direct methods.

  • Subscriptions automatically renew unless canceled before the renewal date.

  • You authorize us and our payment processors to charge your chosen payment method for recurring fees.

5. Refund Policy

  • Refunds are only available within 7 days of purchase.

  • No refunds are provided after 7 days.

6. Data and Privacy

  • We collect and use your personal data as described in our Privacy Policy.

  • By using InstaCOM, you consent to the processing of your data, including international transfers.

7. Third-Party Services

  • InstaCOM uses third-party APIs (Google Gemini, OpenAI, Cerebras, etc.) to generate AI-powered comments.

  • We are not responsible for third-party services, their availability, or their data handling practices.

8. Limitation of Liability

To the maximum extent permitted by law:

  • InstaCOM and Adifa Internet Pvt. Ltd. shall not be liable for indirect, incidental, or consequential damages.

  • We do not guarantee uninterrupted, error-free, or perfectly accurate outputs from AI models.

  • Your use of InstaCOM is at your own risk.

9. Termination

We reserve the right to suspend or terminate your account or access to InstaCOM at any time if you violate these Terms or misuse the Extension.

10. Intellectual Property

  • InstaCOM, its design, logos, trademarks, and content are the intellectual property of Adifa Internet Private Limited.

  • You may not reproduce, distribute, or exploit any part of InstaCOM without written permission.

11. Governing Law and Jurisdiction

  • These Terms are governed by the laws of India.

  • Any disputes shall be subject to the jurisdiction of courts in Ranchi, Jharkhand, India.

12. Changes to Terms

We may update these Terms from time to time. Continued use of InstaCOM after changes means you accept the updated Terms.
